Srinagar: Special Judge Anti-Corruption Srinagar on Saturday granted 10 days bail to former Jammu and Kashmir Bank chairman Parvez Ahmad Nengroo by taking in view the “extra ordinary situation prevailing because of COVID-19 pandemic.”
“Having taken in regard all the facts & circumstances and all other facts/circumstances including duration of custody of the petitioner (Nengroo) & the directions of the Supreme Court and that of Justice Ali Mohammad Magrey, for release of prisoners in J&K in view of the Covid 19 pandemic into consideration, the status of the investigation and the objections raised by the prosecution, in the opinion of the court the accused-petitioner deserve concession of bail,” the presiding officer of the court C. L. Bavoria said.
“However, in view of the objections of prosecution that the investigation has not completed and the presence of the accused is required by the investigating agency to question/examine the rest of files of ABATS/BATS seized in case FIR No. 10/2019, the accused/petitioner is admitted to interim bail in both the FIRs i.e. FIR Nos. 14/2020 & 01/2020 till 31.05.2021 on furnishing of bail bonds of Rs. 1.00 lakh in each of the FIRs and personal bonds of like amount with one surety.”
The court also subjected the bail to certain conditions including that the former J&K bank chairman shall appear before Investigation Officer during the interim bail in between from 10.00 AM to 2.00 PM as and when called by the IO.
That he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or the case as to dissuade him to disclose such facts to the court or any other authority. “The accused shall not leave the jurisdiction of court without prior permission and if the accused/petitioner fails to fulfill the conditions, the prosecution shall be at liberty to approach the court for cancellation of his bail,” the court said and ordered that the application come up for further proceedings on May 31.
